'Corrective and distributive justice are less at odds, in directing Essay
'Corrective and distributive justice are less at odds, in directing the scope of tort liability, than is commonly believed'. Cri - Essay Example Tort law, however, does not recognize just any injury as a basis of claim in tort. It distinguishes between two general classes of duties that include duties not to injure and duties not to injure intentionally or negligently. Individuals who engage in activities that are regarded to be dangerous by the law will be subjected to duties of the first sort. When people engage in activities of ordinary riskiness such as driving, they will be subjected to duties of the second sort (Jules and Mendlow, 11 2010). Tort law is torn between two competing justices. Some theorists believe that justice in tort is a matter of corrective justice. This is concerned exclusively with rectification of losses that have been caused due to negligence. Other theorists dispute this and they challenge this belief. They believe that tort law is a matter of distributive justice which deals with fair apportionment of benefits and losses of risky activities. Distributive justice plays a huge role in tort laws as i t offers an explanation to existence of strict liability in tort law. Corrective and distributive justices are applied in directing the scope of liability. The fundamental difference between corrective and distributive justice relates to the legal approach to structure of interactions. Corrective justice focuses on transaction between two parties while distributive justice focuses on distribution where compensation will be awarded to group members (Park, 40 2000). For example, a case of personal injury can be organized either correctively or distributively. When the case is organized correctively, an injury is a tort committed by a party to a victim. Compensation of damages to the victim will restore the equality disturbed by the negligence of the guilty party. Distributively, this same case will activate a compensation scheme that distributes resources among a group of recipients and contributors according to the criteria of distribution. A corrective justice system focuses on corr ecting wrongful acts of an accused party. The tort of negligence has developed a legal notion of wrongful act for the main aim of establishing liability. Fault based liability is, however, limited to confines of rigid test of duty of care, foresee ability and proximity. Corrective Justice versus Distributive Justice Some theorists do not really believe that corrective justice is an independent principle of tort law. This is because considerations which make corrective justice appear as a genuine principle are the same principles that undermine its independence from distributive justice. Also considerations that support corrective justiceââ¬â¢s independence from distributive justice still undermine its status as an independent and genuine principle of tort law. These considerations arise from the fact that corrective justice needs reversal of negligent acts to an initial distribution of resources. If initial distribution of resources is just, then corrective justice requires that individuals are returned to a position where they are entitled as a matter of distributive justice. This, therefore, shows that corrective justice is indeed distributive justice but from an ex post perspective instead of being an independent principle of tort law. However, if initial distribution of resources is unjust, then principle of corrective justice will require law makers to sustain, entrench and enforce what is ex hypothesi an injustice. There are ongoing discussions regarding the relationship between corrective just

Phenomenological Description and Interpretation All five of the archetypal shapes are in my self-portrait. First of all, the outside appearance is that of a square of rectangle. I feel that people who do not know me do not perceive any of the characteristics that the other shapes represent. Stability is the only characteristic represented by the shapes that people perceive of me. Inside my stable world is a circle in the middle of the bottom of the box. Within the circle is a triangle. This represents how spirituality is the center of my inner self and I find balance within my spirituality. Coming up from the center of the box is a spiral. As the spiral reaches its apex, there is an equidistant cross. This represents how I am constantly growing in order to reach a critical decision-making time of my life (what I want to do for the rest of my life). All of the Yoruba chromatics have been used in portraying my personality. But the most abundant type by far is dudu. The majority of the inside of my box are colors of brown, black, and gray. These colors show how I am very practical and down to earth. People who do not know me see me as down to earth and this does not change even when one gets to know me. The person at the bottom of the box has all three types on him. This represents how at some point in time my close friends see all the personality traits (aloof, passionate, and practical). The inside of the circle at the bottom of the box is colored orange. This shows how I am more passionate when it comes to my spirituality. The inside of the triangle is colored shades of red and blue. This shows how I am passionate, yet cool since I have found a balance. à à à à à à à à à à à à à à à à à à à à à à à à à à à à à à à à à à à à à à à à Sexton 2 The color contrast of my self-portrait is very weak. There are no strong contrasts between light and dark. I am not dramatic or intense by any means. The weak contrast in colors illustrates how I have a subtle personality. The lack of pastel colors shows that I do not have a delicate personality. The line directions in my self-portrait are all horizontal and vertical. The majority of the direction is horizontal, which shows how my personality is very passive. The vertical lines show that I have a stable personality as well as the potential to be dynamic.

Literature and Online College Newspaper
Persepolis by Marjane Satrapi is a graphic novel that depicts the life of a female coming to age during a time of war and violence in Iranian. The editor of The Ithacan, an online college newspaper, criticized this work of literature as being nothing more than an ââ¬Å"advanced comic bookâ⬠and ââ¬Å"not too challenging. â⬠He argues that Persepolis and similar literary works do not encourage intellectual advancement and does not benefit college freshmen. Despite the more basic vocabulary, the side narratives, unique dialogues, and use of illustrations evoke understanding and compassion for not only the narrator, but also the underlying themes.Generally speaking, a novel about Iranian politics and war is a topic that is hard for most young people to grasp or to find interesting because subjects such as these are very foreign to American readers. Persepolis assists in making this topic more relatable. By using graphics to depict the characterââ¬â¢s expressions, settings and actions it is easier for the reader to connect. For example, on page 53, Satrapi illustrates the many ways in which Iranian young people express their feelings about the violent atmosphere. They cope with this situation by turning to family, friends and God. In addition, the author shows the children creating games and a fantasy world that compares their lives to the lives of the tortured. An example of the effectiveness of the illustrations and narrative is shown on page 116. The frame depicts soldiers amidst bombs, gunshots and smoke with multiple soldiers lying on the ground, dead. Marjane, the narrator, is standing in the upper left corner appearing helpless. Marjane is then shown exiting the frame stating that the situation could have been avoided. This is a powerful message because it relates to the current situation in the Middle East where American soldiers and innocent civilians are killed everyday. The value of Satrapiââ¬â¢s use of dialogue to enrich the narrative is evident on page 197. In response to overhearing her collogues prejudiced comments, she angrily retorts ââ¬Å"I am Iranian and proud of it! â⬠(197). This simple statement shows that proud of her nationality and will not tolerate negative statements applied to it. On this page she then states her comprehension of her grandmotherââ¬â¢s advice. If [she] wasnââ¬â¢t comfortable with [herself], [she] would never be comfortableâ⬠(197). This is indicative of her self-growth and acceptance of her ethnicity. Literature comes in many forms and styles. These include novels, memoirs, plays, poetry and non-fiction. Graphic novels are just another medium in which authors can express their viewpoint and influence readers. One type of literature is not better than another; the vocabulary, sentence structure and degree of difficulty does not correlate to the books worth. What is more important is how it influences a reader and the thought process and intellectual stimulation that co mes about. Therefore, Persepolis is more than an ââ¬Å"advanced comic bookâ⬠. It is an engaging, enlightening piece of literature that portrays a violent time period in the Middle East that can be universally applied to other situations in the world today. Taking a Look at the Great Depression - 557 Words
The United States in the 1920ââ¬â¢s was a land of great wealth and prosperity. With the rise of industrialism, fortunes were being made. Along with the wealth and prosperity came lavishness and excess the likes of which hadnââ¬â¢t been seen since ancient Rome. Even the prohibition was in effect, the liquor flowed and with it, so did the cash. There was no end in sight. There was no reason to think it would end. It was this nearsightedness along with numerous other unforeseen circumstances that lead to the dreaded Black Thursday. A day in October of 1929 which saw stocks plummet and America sink into a great depression, as people had taken out unimaginably large loans with no way of paying them back. A day which saw many Americans lose everything they had. A day which saw many Americans take their own lives. The excess of the 1920ââ¬â¢s caused the Great Depression to hit that much harder.
